حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، ‏‏‏‏‏‏حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ، ‏‏‏‏‏‏حَدَّثَنَا أُسَامَةُ بْنُ زَيْدٍ، ‏‏‏‏‏‏عَنِ الزُّهْرِيِّ، ‏‏‏‏‏‏عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَزْهَرَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَدَاةَ الْفَتْحِ وَأَنَا غُلَامٌ شَابٌّ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ، ‏‏‏‏‏‏فَأُتِيَ بِشَارِبٍ فَأَمَرَهُمْ فَضَرَبُوهُ بِمَا فِي أَيْدِيهِمْ فَمِنْهُمْ مَنْ ضَرَبَهُ بِالسَّوْطِ وَمِنْهُمْ مَنْ ضَرَبَهُ بِعَصًا وَمِنْهُمْ مَنْ ضَرَبَهُ بِنَعْلِهِ، ‏‏‏‏‏‏وَحَثَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ التُّرَابَ، ‏‏‏‏‏‏فَلَمَّا كَانَ أَبُو بَكْرٍ أُتِيَ بِشَارِبٍ فَسَأَلَهُمْ عَنْ ضَرْبِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الَّذِي ضَرَبَهُ فَحَزَرُوهُ أَرْبَعِينَ، ‏‏‏‏‏‏فَضَرَبَ أَبُو بَكْرٍ أَرْبَعِينَ، ‏‏‏‏‏‏فَلَمَّا كَانَ عُمَرُ كَتَبَ إِلَيْهِ خَالِدُ بْنُ الْوَلِيدِ:‏‏‏‏ إِنَّ النَّاسَ قَدِ انْهَمَكُوا فِي الشُّرْبِ وَتَحَاقَرُوا الْحَدَّ وَالْعُقُوبَةَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ هُمْ عِنْدَكَ فَسَلْهُمْ وَعِنْدَهُ الْمُهَاجِرُونَ الْأَوَّلُونَ، ‏‏‏‏‏‏فَسَأَلَهُمْ فَأَجْمَعُوا عَلَى أَنْ يَضْرِبَ ثَمَانِينَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وقَالَ عَلِيٌّ:‏‏‏‏ إِنَّ الرَّجُلَ إِذَا شَرِبَ افْتَرَى فَأَرَى أَنْ يَجْعَلَهُ كَحَدِّ الْفِرْيَةِ ، ‏‏‏‏‏‏قَالَ أَبُو دَاوُد:‏‏‏‏ أَدْخَلَ عُقَيْلُ بْنُ خَالِدٍ بَيْنَ الزُّهْرِيِّ، ‏‏‏‏‏‏وَبَيْنَ ابْنِ الْأَزْهَرِ، ‏‏‏‏‏‏فِي هَذَا الْحَدِيثِ:‏‏‏‏ عَبْدَ اللَّهِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْأَزْهَرِ، ‏‏‏‏‏‏عَنْ أَبِيهِ.

عبدالرحمٰن بن ازہر کہتے ہیں کہ   میں نے فتح مکہ کے دوسرے دن صبح کو رسول اللہ صلی اللہ علیہ وسلم کو دیکھا میں ایک کمسن لڑکا تھا، لوگوں میں گھس کر آیا جایا کرتا تھا، آپ خالد بن ولید رضی اللہ عنہ کی قیام گاہ ڈھونڈ رہے تھے کہ اتنے میں ایک شرابی لایا گیا، آپ نے اسے مارنے کا حکم دیا، تو لوگوں کے ہاتھوں میں جو چیز بھی تھی اسی سے انہوں نے اس کی پٹائی کی، کسی نے اسے کوڑے سے، کسی نے لاٹھی سے، کسی نے جوتے سے پیٹا، اور رسول اللہ صلی اللہ علیہ وسلم نے اس کے منہ پر مٹی ڈال دی، پھر جب ابوبکر رضی اللہ عنہ کا زمانہ آیا تو ان کے پاس ایک شرابی لایا گیا تو انہوں نے لوگوں سے نبی اکرم صلی اللہ علیہ وسلم کی اس مار کے متعلق دریافت کیا جسے آپ نے مارا تھا تو لوگوں نے اس کا اندازہ لگایا کہ یہ چالیس کوڑے رہے ہوں گے، تو ابوبکر رضی اللہ عنہ نے اس کی حد چالیس کوڑے مقرر کر دی، پھر جب عمر رضی اللہ عنہ کا زمانہ آیا تو خالد بن ولید نے انہیں لکھا کہ لوگ کثرت سے شراب پینے لگے ہیں اور اس کی حد اور سزا کو کوئی اہمیت نہیں دیتے اور لکھا کہ لوگ آپ کے پاس ہیں ان سے پوچھ لیں، اس وقت ان کے پاس مہاجرین اولین موجود تھے، آپ نے ان سے پوچھا تو سب کا اس بات پر اتفاق ہو گیا کہ اسی کوڑے مارے جائیں، علی رضی اللہ عنہ نے کہا: آدمی جب شراب پیتا ہے تو بہتان باندھتا ہے اس لیے میری رائے یہ ہے کہ اس کی حد بہتان کی حد کر دی جائے۔

Narrated Abdur Rahman ibn Azhar: I saw the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم on the morning of the conquest of Makkah when I was a young boy. He was walking among the people, seeking the camp of Khalid ibn al-Walid. A man who had drunk wine was brought (before him) and he ordered them (to beat him). So they beat him with what they had in their hands. Some struck him with whips, some with sticks and some with sandals. The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم threw some dust on his face. When a man who had drunk wine was brought before Abu Bakr, he asked them (i. e. the people) about the number of beatings which they gave him. They numbered it forty. So Abu Bakr gave him forty lashes. When Umar came to power, Khalid ibn al-Walid wrote to him: The people have become addicted to drinking wine and they look down upon the prescribed punishment and its penalty. He said: They are with you, ask them. The immigrants who embraced Islam in the beginning were with him. He asked them and they agreed on the fact that (a drunkard) should be given eighty lashes. Ali said: When a man drinks wine, he tells lies. I, therefore, think that he should be prescribed punishment that is prescribed for telling lies. . Abu Dawud said: 'Uqail bin Khalid included in the chain of this tradition: Abdullah bin Abdur-Rahman bin al-Azhar from his father between al-Zuhri and Ibn al-Azhar.

Hadith 4351

Ikrimah said: Ali burned some people who retreated from islam. When Ibn Abbas was informed of it, he said: If it had been I, I would not have then burned, for the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said: Do not inflict Allah’s punishment on anyone, but would have had killed them on account of the statement of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم. The Messenger said: Kill those who change their religion. When ‘All was informed about it he said: How truly Ibn Abbas said!

Hadith 4352

Abdullah (bin Masud) reported the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم as saying: The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community.

Narrated Aishah, Ummul Muminin: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم Said: The blood of a Muslim man who testifies that there is no god but Allah and that Muhammad is Allah's Messenger should not lawfully be shed except only for one of three reasons: a man who committed fornication after marriage, in which case he should be stoned; one who goes forth to fight with Allah and His Messenger, in which case he should be killed or crucified or exiled from the land; or one who commits murder for which he is killed.

Hadith 4354

Abu Burdah said on the authority of Abu Musa: I went to the Prophet صلی ‌اللہ ‌علیہ ‌وسلم while two men who were Ash’ arIs were with me. One of them was on my right and the other on my left side. Bothe of them asked him for employment. The prophet صلی ‌اللہ ‌علیہ ‌وسلم was silent. He asked: What do you say Abu Musa, or Abdullah bin Qais (Abu Musa’s name)? I replied: By him who has sent you with truth, they did not inform me of what they had in their hearts, and I did not know that they would ask for an employment. He said: I have the scene before my eyes that he had his toothstick below his lip which receded. He (the prophet) said: We will never or will not put in charge of our work anyone who asks for it. But go, ye, Abu Musa, or Abdullah bin Qais. He then sent him as a Governor of the Yemen, After him he sent Muadh bin Jabal. When Muadh came to him, he said: come down, and he put a cushion for him. He saw that a man was chained with him. He asked: What is this? He replied: He was a Jew and he accepted Islam. He then converted to his religion, an evil religion. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی ‌اللہ ‌علیہ ‌وسلم. He said: Yes, be seated. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی ‌اللہ ‌علیہ ‌وسلم. He said it three times. He then commanded for it and he was killed. Both of them then discussed the question of prayer and vigilance at night. One of them, probably Muadh, said: So far as I am concerned, I sleep and I keep vigilance: I keep vigilance and I sleep: I hope for the same reward for my sleep as for my vigilance.

Hadith 4355

Narrated Muadh ibn Jabal: Abu Musa said: Muadh came to me when I was in the Yemen. A man who was Jew embraced Islam and then retreated from Islam. When Muadh came, he said: I will not come down from my mount until he is killed. He was then killed. One of them said: He was asked to repent before that.
