حَدَّثَنَا يَزِيدُ بْنُ خَالِدٍ الرَّمْلِيُّ، حَدَّثَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، عَنْ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ، أَنَّهَا أَخْبَرَتْهُ، أَنَّهَا كَانَتْ عِنْدَ أَبِي حَفْصِ بْنِ الْمُغِيرَةِ، وَأَنَّ أَبَا حَفْصِ بْنَ الْمُغِيرَةِ طَلَّقَهَا آخِرَ ثَلَاثِ تَطْلِيقَاتٍ، فَزَعَمَتْ أَنَّهَا جَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاسْتَفْتَتْهُ فِي خُرُوجِهَا مِنْ بَيْتِهَا، فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ الْأَعْمَى، فَأَبَى مَرْوَانُ أَنْ يُصَدِّقَ حَدِيثَ فَاطِمَةَ فِي خُرُوجِ الْمُطَلَّقَةِ مِنْ بَيْتِهَا، قَالَ عُرْوَةُ: وَأَنْكَرَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ. قَالَ أَبُو دَاوُد: وَكَذَلِكَ رَوَاهُ صَالِحُ بْنُ كَيْسَانَ، وَ ابْنُ جُرَيْجٍ وَ شُعَيْبُ بْنُ أَبِي حَمْزَةَ، كُلُّهُمْ عَنْ الزُّهْرِيِّ. قَالَ أَبُو دَاوُد: شُعَيْبُ بْنُ أَبِي حَمْزَةَ، وَاسْمُ أَبِي حَمْزَةَ دِينَارٌ وَهُوَ مَوْلَى زِيَادٍ.
ابوسلمہ بن عبدالرحمٰن بن عوف الزہری کہتے ہیں کہ فاطمہ بنت قیس رضی اللہ عنہا نے انہیں خبر دی کہ وہ ابوحفص بن مغیرہ رضی اللہ عنہ کے عقد میں تھیں، اور ابوحفص نے انہیں تین طلاق میں سے آخری طلاق بھی دے دی تو وہ رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئیں اور اپنے گھر نکلنے کے متعلق آپ صلی اللہ علیہ وسلم سے فتویٰ پوچھا تو آپ نے انہیں نابینا ابن ام مکتوم رضی اللہ عنہ کے گھر منتقل ہو جانے کا حکم دیا ۱؎۔ مروان نے یہ حدیث سنی تو مطلقہ کے گھر سے نکلنے کے سلسلہ میں فاطمہ رضی اللہ عنہا کی حدیث کی تصدیق کرنے سے انکار کیا، عروہ کہتے ہیں: ام المؤمنین عائشہ رضی اللہ عنہا نے بھی فاطمہ بنت قیس رضی اللہ عنہا کی بات کا انکار کیا۔
Abu Salamah reported on the authority of Fatimah daughter of Qays who said to him that she was the wife of AbuHafs ibn al-Mughirah who divorced her by three pronouncements. She said that she came to the Messenger of Allah صلی اللہ علیہ وسلم and sought his opinion about her going out from her house. He commanded her to shift to (the house of )Ibn Umm Maktum who was blind. Marwan denied to confirm the tradition of Fatimah about the going out of a divorced woman from her house. Urwah said: Aishah objected to Fatimah daughter of Qays. Abu Dawud said: Salih bin Kaisan, Ibn Juraij, and Shuaib bin Abi Hamzah -- all of them narrated on the authority of al-Zuhru in a similar way. Abu Dawud said: Shuaibn bin Abi Hamzah the name of Abu Hamzah is Dinar. He is a client of Ziyad.
Narrated Abu Hurairah: The Prophet صلی اللہ علیہ وسلم said: Anyone who incites a woman against her husband or a slave against his master is not one of us.

So Umar bin Al Khattab asked the Messenger of Allah صلی اللہ علیہ وسلم about this matter. The Messenger of Allah صلی اللہ علیہ وسلم said “Order him, he must take her back and keep her back till she is purified, then has another menstrual period and is purified. Thereafter if he desires he may divorce her before having intercourse with her, for that is the period of waiting which Allaah the Glorified has commanded for the divorce of women. ”
