حَدَّثَنَا خَلَّادُ بْنُ يَحْيَى ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ أَيْمَنَ الْمَكِّيُّ ، عَنْ أَبِيهِ ، قَالَ : دَخَلْتُ عَلَى عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : دَخَلَتْ عَلَيَّ بَرِيرَةُ وَهِيَ مُكَاتَبَةٌ ، فَقَالَتْ : يَا أُمَّ الْمُؤْمِنِينَ ، اشْتَرِينِي ، فَإِنَّ أَهْلِي يَبِيعُونِي فَأَعْتِقِينِي ، قَالَتْ : نَعَمْ ، قَالَتْ : إِنَّ أَهْلِي لَا يَبِيعُونِي حَتَّى يَشْتَرِطُوا وَلَائِي ، قَالَتْ : لَا حَاجَةَ لِي فِيكِ ، فَسَمِعَ ذَلِكَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَوْ بَلَغَهُ ، فَقَالَ : مَا شَأْنُ بَرِيرَةَ ؟ فَقَالَ : اشْتَرِيهَا فَأَعْتِقِيهَا ، وَلْيَشْتَرِطُوا مَا شَاءُوا ، قَالَتْ : فَاشْتَرَيْتُهَا فَأَعْتَقْتُهَا ، وَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : الْوَلَاءُ لِمَنْ أَعْتَقَ ، وَإِنِ اشْتَرَطُوا مِائَةَ شَرْطٍ .

ہم سے خلاد بن یحییٰ نے بیان کیا، کہا ہم سے عبدالواحد بن ایمن مکی نے بیان کیا، ان سے ان کے باپ نے بیان کیا کہ میں عائشہ رضی اللہ عنہا کی خدمت میں حاضر ہوا تو آپ نے بتلایا کہ   بریرہ رضی اللہ عنہ میرے یہاں آئیں، انہوں نے کتابت کا معاملہ کر لیا تھا۔ مجھ سے کہنے لگیں کہ اے ام المؤمنین! مجھے آپ خرید لیں، کیونکہ میرے مالک مجھے بیچنے پر آمادہ ہیں، پھر آپ مجھے آزاد کر دینا۔ عائشہ رضی اللہ عنہا نے فرمایا کہ ہاں ( میں ایسا کر لوں گی ) لیکن بریرہ رضی اللہ عنہا نے پھر کہا کہ میرے مالک مجھے اسی وقت بیچیں گے جب وہ ولاء کی شرط اپنے لیے لگا لیں۔ اس پر عائشہ رضی اللہ عنہا نے فرمایا کہ پھر مجھے ضرورت نہیں ہے۔ جب نبی کریم صلی اللہ علیہ وسلم نے سنا، یا آپ صلی اللہ علیہ وسلم کو معلوم ہوا ( راوی کو شبہ تھا ) تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ بریرہ ( رضی اللہ عنہا ) کا کیا معاملہ ہے؟ تم انہیں خرید کر آزاد کر دو، وہ لوگ جو چاہیں شرط لگا لیں۔ عائشہ رضی اللہ عنہا نے کہا کہ میں نے بریرہ کو خرید کر آزاد کر دیا اور اس کے مالک نے ولاء کی شرط اپنے لیے محفوظ رکھی۔ آپ صلی اللہ علیہ وسلم نے یہی فرمایا کہ ولاء اسی کی ہوتی ہے جو آزاد کرے ( دوسرے ) جو چاہیں شرط لگاتے رہیں۔

Narrated Aiman Al-Makki: When I visited Aisha she said, Buraira who had a written contract for her emancipation for a certain amount came to me and said, O mother of the believers! Buy me and manumit me, as my masters will sell me. Aisha agreed to it. Buraira said, 'My masters will sell me on the condition that my Wala will go to them. Aisha said to her, 'Then I am not in need of you.' The Prophet heard of that or was told about it and so he asked Aisha, 'What is the problem of Buraira?' He said, 'Buy her and manumit her, no matter what they stipulate.' Aisha added, 'I bought and manumitted her, though her masters had stipulated that her Wala would be for them.' The Prophet said, The Wala is for the liberator, even if the other stipulated a hundred conditions.

Hadith 2711

Narrated Marwan and al-Miswar bin Makhrama: (from the companions of Allah's Apostle) When Suhail bin `Amr agreed to the Treaty (of Hudaibiya), one of the things he stipulated then, was that the Prophet should return to them (i.e. the pagans) anyone coming to him from their side, even if he was a Muslim; and would not interfere between them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not agree except with that condition. So, the Prophet agreed to that condition and returned Abu Jandal to his father Suhail bin `Amr. Thenceforward the Prophet returned everyone in that period (of truce) even if he was a Muslim. During that period some believing women emigrants including Um Kulthum bint `Uqba bin Abu Muait who came to Allah's Apostle and she was a young lady then. Her relative came to the Prophet and asked him to return her, but the Prophet did not return her to them for Allah had revealed the following Verse regarding women: O you who believe! When the believing women come to you as emigrants. Examine them, Allah knows best as to their belief, then if you know them for true believers, Send them not back to the unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful (husbands) for them (60.10)

Hadith 2712

Hadith 2713

Narrated `Urwa: Aisha told me, Allah's Apostle used to examine them according to this Verse: O you who believe! When the believing women come to you, as emigrants test them . . . for Allah is Oft- Forgiving, Most Merciful. (60.10-12) Aisha said, When any of them agreed to that condition Allah's Apostle would say to her, 'I have accepted your pledge of allegiance.' He would only say that, but, by Allah he never touched the hand of any women (i.e. never shook hands with them) while taking the pledge of allegiance and he never took their pledge of allegiance except by his words (only).
