حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا سُفْيَانُ، عَنْ ابْنِ أَبِي نَجِيحٍ، عَنْ عَبْدِ اللَّهِ بْنِ كَثِيرٍ، عَنْ أَبِي الْمِنْهَالِ، عَنْ ابْنِ عَبَّاسٍ، قَالَ:‏‏‏‏ قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ، ‏‏‏‏‏‏وَهُمْ يُسْلِفُونَ فِي الثَّمَرِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ مَنْ أَسْلَفَ، ‏‏‏‏‏‏فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ، ‏‏‏‏‏‏وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ ابْنِ أَبِي أَوْفَى، ‏‏‏‏‏‏وَعَبْدِ الرَّحْمَنِ بْنِ أَبْزَى. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏أَجَازُوا السَّلَفَ فِي الطَّعَامِ، ‏‏‏‏‏‏وَالثِّيَابِ وَغَيْرِ ذَلِكَ، ‏‏‏‏‏‏مِمَّا يُعْرَفُ حَدُّهُ، ‏‏‏‏‏‏وَصِفَتُهُ، ‏‏‏‏‏‏وَاخْتَلَفُوا فِي السَّلَمِ فِي الْحَيَوَانِ، ‏‏‏‏‏‏فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏السَّلَمَ فِي الْحَيَوَانِ جَائِزًا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَكَرِهَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏السَّلَمَ فِي الْحَيَوَانِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ، ‏‏‏‏‏‏وَأَهْلِ الْكُوفَةِ، ‏‏‏‏‏‏أَبُو الْمِنْهَالِ اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ مُطْعِمٍ.

عبداللہ بن عباس رضی الله عنہما کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم مدینہ تشریف لائے اور اہل مدینہ پھلوں میں سلف کیا کرتے تھے یعنی قیمت پہلے ادا کر دیتے تھے، آپ نے فرمایا: ”جو سلف کرے وہ متعین ناپ تول اور متعین مدت میں سلف کرے“۔ امام ترمذی کہتے ہیں: ۱- ابن عباس رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- اس باب میں ابن ابی اوفی اور عبدالرحمٰن بن ابزی رضی الله عنہما سے بھی احادیث آئی ہیں، ۳- صحابہ کرام وغیرہم میں سے اہل علم کا اسی پر عمل ہے۔ یہ لوگ غلہ، کپڑا، اور جن چیزوں کی حد اور صفت معلوم ہو اس کی خریداری کے لیے پیشگی رقم دینے کو جائز کہتے ہیں، ۴- جانور خریدنے کے لیے پیشگی رقم دینے میں اختلاف ہے، ۵- بعض اہل علم جانور خریدنے کے لیے پیشگی رقم دینے کو جائز کہتے ہیں۔ شافعی، احمد اور اسحاق بن راہویہ کا بھی یہی قول ہے۔ اور صحابہ کرام وغیرہم میں سے بعض اہل علم نے جانور خریدنے کے لیے پیشگی دینے کو مکروہ سمجھا ہے۔ سفیان اور اہل کوفہ کا یہی قول ہے۔

Narrated Ibn 'Abbas: When the Prophet (ﷺ) arrived in Al-Madinah, they were paying in advance for fruits. So he said: 'Whoever pays in advance, then let him pay in advance for known measurements (of dates), and known weights for a specified period of time.' He said: There are narrations on this topic from Ibn Abi Awfa and 'Abdur-Rahman bin Abza. [Abu 'Eisa said:] The Hadith of Ibn 'Abbas is a Hasan Sahih Hadith. This is acted upon according to the people of knowledge among the Companions of the Prophet (ﷺ) and others. They allow for advanced payments on food, garments and other things in which the limits and description are known. They differed over delay in delivery of animals. Some of the people of knowledge among the Companions of the Prophet (ﷺ) and others thought that delay in delivery of animals is allowed. This is the view of Ash-Shafi'i, Ahmad and Ishaq. Some of the people of knowledge among the Companions of the Prophet (ﷺ) and others, disliked delay in delivery of animals. This is the saying of Sufyan and the people of Al-Kufah. And Abu Al-Minhal's (a narrator) name is 'Abdur-Rahman bin Mut'im.

Hadith 1205

An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.

[Abu 'Eisa said:] The Hadith of Qais bin Abi Gharazah (a narrator) is a Hasan Sahih Hadith. Mansur, Al-A'mash, Habib bin Abi Thabit and others reported it from Abu Wa'il, from Qais bin Abi Gharzah, from the Prophet (ﷺ). We do not know of anything from the Prophet (ﷺ) narrated by Qais other than this.

Hadith 1209

Abu Sa'eed narrated that the Prophet (ﷺ) said: The truthful, trustworthy merchant is with the Prophets, the truthful, and the martyrs. [Abu 'Eisa said:] This Hadith is Hasan, we do not know it except from this route, a narration of Ath-Thawri from Abu Hamzah. Abu Hamzah's name is 'Abdullah bin Jabir, and he is a Shaikh from Al-Basrah.
