حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنْ ابْنِ عَبَّاسٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ . قَالَ ابْنُ عَبَّاسٍ:‏‏‏‏ وَأَحْسِبُ كُلَّ شَيْءٍ مِثْلَهُ. قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏وَابْنِ عُمَرَ، ‏‏‏‏‏‏وَأَبِي هُرَيْرَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏كَرِهُوا بَيْعَ الطَّعَامِ، ‏‏‏‏‏‏حَتَّى يَقْبِضَهُ الْمُشْتَرِي، ‏‏‏‏‏‏وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِيمَنِ ابْتَاعَ شَيْئًا مِمَّا لَا يُكَالُ وَلَا يُوزَنُ مِمَّا لَا يُؤْكَلُ، ‏‏‏‏‏‏وَلَا يُشْرَبُ، ‏‏‏‏‏‏أَنْ يَبِيعَهُ قَبْلَ أَنْ يَسْتَوْفِيَهُ، ‏‏‏‏‏‏وَإِنَّمَا التَّشْدِيدُ عِنْدَ أَهْلِ الْعِلْمِ فِي الطَّعَامِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق.

عبداللہ بن عباس رضی الله عنہما سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جو شخص غلہ خریدے تو اسے نہ بیچے جب تک کہ اس پر قبضہ نہ کر لے“ ۱؎، ابن عباس رضی الله عنہما کہتے ہیں: میں ہر چیز کو غلے ہی کے مثل سمجھتا ہوں۔ امام ترمذی کہتے ہیں: ۱- ابن عباس رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- اس باب میں جابر، ابن عمر اور ابوہریرہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- اکثر اہل علم کا اسی پر عمل ہے، ان لوگوں نے غلہ کی بیع کو ناجائز کہا ہے۔ جب تک مشتری اس پر قبضہ نہ کر لے، ۴- اور بعض اہل علم نے قبضہ سے پہلے اس شخص کو بیچنے کی رخصت دی ہے جو کوئی ایسی چیز خریدے جو ناپی اور تولی نہ جاتی ہو اور نہ کھائی اور پی جاتی ہو، ۵- اہل علم کے نزدیک سختی غلے کے سلسلے میں ہے۔ احمد اور اسحاق بن راہویہ کا بھی یہی قول ہے۔

Narrated Ibn 'Abbas: That the Prophet (ﷺ) said: Whoever buys food, then he is not to sell it until he takes possession of it. Ibn 'Abbas said: All things are considered the same (in this regard). [He said:] There are narrations on this topic from Jabir, Ibn 'Umar, and Abu Hurairah. [Abu 'Eisa said:] The Hadith of Ibn 'Abbas is a Hasan Sahih Hadith.

Hadith 1205

An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.

Hadith 1208

Abu Wa'il narrated that Qais bin Abi Gharazah said: The Messenger of Allah (S) came to us, and we were what was called 'brokers,' he said: 'O people of trade! Indeed the Shaitan and sin are present in the sale, so mix your sales with charity.' He said: There are narrations on this topic from Al-Bara' bin 'Azib and Rifa'ah. [Abu 'Eisa said:] The Hadith of Qais bin Abi Gharazah (a narrator) is a Hasan Sahih Hadith. Mansur, Al-A'mash, Habib bin Abi Thabit and others reported it from Abu Wa'il, from Qais bin Abi Gharzah, from the Prophet (ﷺ). We do not know of anything from the Prophet (ﷺ) narrated by Qais other than this.

Hadith 1209

Abu Sa'eed narrated that the Prophet (ﷺ) said: The truthful, trustworthy merchant is with the Prophets, the truthful, and the martyrs. [Abu 'Eisa said:] This Hadith is Hasan, we do not know it except from this route, a narration of Ath-Thawri from Abu Hamzah. Abu Hamzah's name is 'Abdullah bin Jabir, and he is a Shaikh from Al-Basrah.
