حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْخَلَّالُ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَخْبَرَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ ابْنِ عُمَرَ، قَالَ:‏‏‏‏ كُنْتُ أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ، ‏‏‏‏‏‏فَآخُذُ مَكَانَهَا الْوَرِقَ، ‏‏‏‏‏‏وَأَبِيعُ بِالْوَرِقِ فَآخُذُ مَكَانَهَا الدَّنَانِيرَ، ‏‏‏‏‏‏فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَوَجَدْتُهُ خَارِجًا مِنْ بَيْتِ حَفْصَةَ، ‏‏‏‏‏‏فَسَأَلْتُهُ عَنْ ذَلِكَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَا بَأْسَ بِهِ بِالْقِيمَةِ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا نَعْرِفُهُ مَرْفُوعًا، ‏‏‏‏‏‏إِلَّا مِنْ حَدِيثِ سِمَاكِ بْنِ حَرْبٍ، ‏‏‏‏‏‏عَنْ سَعِيدِ بْنِ جُبَيْرٍ، ‏‏‏‏‏‏عَنْ ابْنِ عُمَرَ، ‏‏‏‏‏‏وَرَوَى دَاوُدُ بْنُ أَبِي هِنْدٍ هَذَا الْحَدِيثَ، ‏‏‏‏‏‏عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ ابْنِ عُمَرَ مَوْقُوفًا، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏أَنْ لَا بَأْسَ أَنْ يَقْتَضِيَ الذَّهَبَ مِنَ الْوَرِقِ وَالْوَرِقَ، ‏‏‏‏‏‏مِنَ الذَّهَبِ وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَقَدْ كَرِهَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ذَلِكَ.

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ   میں بقیع کے بازار میں اونٹ بیچا کرتا تھا، میں دیناروں سے بیچتا تھا، اس کے بدلے چاندی لیتا تھا، اور چاندی سے بیچتا تھا اور اس کے بدلے دینار لیتا تھا، میں رسول اللہ صلی اللہ علیہ وسلم کے پاس آیا اور میں نے آپ کو دیکھا کہ آپ حفصہ رضی الله عنہا کے گھر سے نکل رہے ہیں تو میں نے آپ سے اس کے بارے میں پوچھا آپ نے فرمایا: ”قیمت کے ساتھ ایسا کرنے میں کوئی مضائقہ نہیں ہے“۔ امام ترمذی کہتے ہیں: ۱- ہم اس حدیث کو صرف سماک بن حرب ہی کی روایت سے مرفوع جانتے ہیں، ۲- سماک نے اسے سعید بن جبیر سے اور سعید نے ابن عمر سے روایت کی ہے اور داود بن ابی ھند نے یہ حدیث سعید بن جبیر سے اور سعید نے ابن عمر سے موقوفاً روایت کی ہے، ۳- بعض اہل علم کا عمل اسی حدیث پر ہے کہ اگر کوئی سونا کے بدلے چاندی لے یا چاندی کے بدلے سونا لے، تو کوئی حرج نہیں ہے۔ یہی احمد اور اسحاق کا بھی قول ہے، ۴- اور صحابہ کرام وغیرہم میں سے بعض اہل علم نے اسے مکروہ جانا ہے۔

Narrated Ibn 'Umar: I would sell camels at Al-Baqi', so I would sell them for Dinar but take in place of them Dirham, and, I would sell for silver and take Dinar in its place. So I went to the Messenger of Allah (ﷺ) and found him leaving the house of Hafsah. I asked him about that and he said: 'There is no harm in that when it (equals) the price.' [Abu 'Eisa said:] We do not know of this Hadith being Marfu' except from the narration of Simak bin Harb from Sa'eed bin Jubair, from Ibn 'Umar. Dawud bin Abi Hind narrated this Hadith from Abu Sa'eed bin Jubair, from Ibn 'Umar in Mawquf form. This is acted upon according to some of the people of knowledge. There is no harm in paying for gold with silver and silver with gold. This is the view of Ahmad and Ishaq. Some of the people of knowledge, among the Companions and others, disliked that.

Hadith 1205

An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.

Hadith 1208

Abu Wa'il narrated that Qais bin Abi Gharazah said: The Messenger of Allah (S) came to us, and we were what was called 'brokers,' he said: 'O people of trade! Indeed the Shaitan and sin are present in the sale, so mix your sales with charity.' He said: There are narrations on this topic from Al-Bara' bin 'Azib and Rifa'ah. [Abu 'Eisa said:] The Hadith of Qais bin Abi Gharazah (a narrator) is a Hasan Sahih Hadith. Mansur, Al-A'mash, Habib bin Abi Thabit and others reported it from Abu Wa'il, from Qais bin Abi Gharzah, from the Prophet (ﷺ). We do not know of anything from the Prophet (ﷺ) narrated by Qais other than this.

Hadith 1209

Abu Sa'eed narrated that the Prophet (ﷺ) said: The truthful, trustworthy merchant is with the Prophets, the truthful, and the martyrs. [Abu 'Eisa said:] This Hadith is Hasan, we do not know it except from this route, a narration of Ath-Thawri from Abu Hamzah. Abu Hamzah's name is 'Abdullah bin Jabir, and he is a Shaikh from Al-Basrah.
